Divorce can follow different procedures. The appropriate route depends on the family circumstances and whether the spouses agree.

Where there is agreement

An agreement sets out the measures appropriate to the family. Divorce before a notary is subject to the requirements of Spain’s Civil Code; it is not available for every agreed divorce.

Where there is disagreement

Court proceedings address matters the spouses cannot agree on. Gather the relevant documents and assess each measure with individual advice.

Choosing a route

Explain your family circumstances, existing agreements and unresolved questions. Do not assume the notarial route is always faster or less expensive.
